deer and didn't feel comfortable stopping at 5:30 in the morning. >> when police investigated this accident around 5:25 sunday morning, they said they did not find any type of reflective equipment or gear on the victim. yet yesterday afternoon, we found this sneaker which the victim's mother tells us belonged to her. we called police and asked them to pick it up. that was yesterday, 6:00 in the afternoon. guess what? it is now tuesday and it is still here. >> so you just called them, you call them and tell them i will be sitting here until they come. i am not moving until they pick the sneaker up. >> maryland state police officers eventually returned to the scene and the investigation would be thorough. somehow wants a law calling

for more safety on bike paths and she wants that law to carry her dead daughter's name. reporting live, i'm armando trull, back to you. >> thank you. a driver accused of hitting a pedestrian now faces involuntary manslaughter charges. this after the 26-year-old austrian woman she allegedly struck died. police say shamika adams was about to turn left off of 18th street when her car ran over the median on september 8. two pedestrians were hit, then the car veered into a restaurant. adams also faces dwi charges. a virginia man is recovering from his injuries tonight after he was attacked and stabbed behind a daycare center in manassas. it happened at the canberry shopping center and that's where peggy fox joins us to tell us more about one of the young suspects under arrest in this attack. peggy. >> that's right. one of the suspects, a 15-year- old boy was caught right away. the other suspect is still on

the loose tonight. police describe them as young, hispanic males. the victim is a 59-year-old man, he is a property assessor who is taking pictures behind the building this morning just trying to do his job. >> just as people were coming to work and just after children arrived at the daycare center right behind the playground, a man who was doing property assessment work and taking pictures was attacked in broad daylight. >> two assailants came up from behind him and demanded his camera and money. when he refused, they attacked him. >> two women saw the attack and started honking their horns. one called her coworker in the process. >> she yelled out to the guy, are you hurt? is everything okay? did they take your wallet? did they rob you? he said yes, they robbed me, they took my wallet and my camera and my cell phone. >> they called 911 and my property manager who was

nearby. he ran to call the injured man. >> he was conscious, breathing. very level headed. >> about a half mile away. police caught one of the suspects, a 15-year-old boy. >> he does attend one of the local schools here and should have been in the school. and i believe he does live in the apartment complex behind this shopping center. >> between the apartments and the shopping center is a brand- new fence. >> they raised the fence here and added more security cameras and they are going to add more to the shopping center. >> the incident left employees here a bit shaken. >> how are you supposed to do your job if you can't walk around the streets without someone harassing you and taking your cameras? >> now even though this center, this shopping center is directly across the street from the prince william hospital, the victim was taken to a nova fairfax hospital for trauma, because he was stabbed several times in the chest and side. good news though, tonight he is

in stable condition and police are confident they will catch that second suspect. reporting live in manassas, peggy fox, 9news now. back to you. >> thank you very much. >> the fbi is on the lookout for a man suspected of robbing dozens of area restaurants. these are some surveillance photos from two of the 38 holdups he is wanted for and they date back to february of last year. restaurants were robbed. the fbi says the man should be considered armed and dangerous. a $10,000 reward is being offered for his capture. prince georges county police made another arrest in the robbery of two university of maryland students. on sunday, andrew turned himself into police. authorities say hilluck and a third man used a gun to rob the victims on august 8 in college park. they are charged with armed robbery and possession of a handgun. a teacher accused of

sexually abusing a minor will avoid jail time. in a plea agreement, 65-year- old robert peterson was sentenced to five years probation. peterson admitted touching a middle schoolboy inappropriately. it is a private school. blocked an effort to repeal the law banning gays from serving openingly in the military. republicans balked when democrats tried to push through the bill. joel. >> yeah, lesley. democrats unable today to deliver on one of president obama's campaign pledges. they were unable, they needed 60 votes to get this bill through. they came up short. >> the senate voted against repealing don't ask, don't tell in the military. >> the motion is not agreed to. >> the democrats were counting on republican susan collins to break him and support the bill. she changed her mind at the last minute. >> i think we should welcome

the service of these individuals, but i cannot vote to proceed to this bill under a situation that is going to shut down the debate and preclude republican amendments. >> even democratic strategists call the vote a train wreck. if democrats lose seats in congress in the midterm elections, it could be harder for president obama to get rid of the ban on gays down the road. another setback for the bill, the president's choice to head the marines told senators repealing don't ask, don't tell during wartime would be a distraction. >> you did not support the statute changes, is that correct? >> senator, i do not -- i don't know yet what the impact on recruiting and retention will be. >> an estimated 13,000 service members has been discharged under the law since it was created under president clinton

in 1993. defense secretary, robert gates asked congress to wait on the vote until the military finished its study. many pow echoed that. the pentagon report is due in december. >> so the house had already passed a similar version of the bill, just like the senate m. it included a provision that would have kept the ban in place until after the pentagon's review was complete. >> what are the chances that the senate could still vote on this before the end of the year? >> i tell you what, majority leader, harry reid said today that this was a real, quote, unquote setback here. he could call for another vote before the year is out and after the elections, but it would be a lame duck session of congress where democrats could bring back fewer than the 59 votes they have now. it's difficult to see the path and may be more difficult the year ahead. joel brown reporting. thank you. maryland's governor's race,

a new poll shows the candidates are running neck in neck. the poll shows democratic incumbent holds a 50 to 47 percent lead over republican challenger, former governor, bob ehrlich. the three point difference is within the poll's 4% margin of error. meaning the race is a dead heat. a maryland woman is making headlines for a question she posed to president obama. val of upper marlboro told the president she is exhausted from defending him and his administration about the economy. >> i have been told that i voted for a man who said he was going to change things in a meaningful way for the middle class. i'm waiting, sir. i'm waiting. i don't feel it yet and i thought, while i wouldn't be a great measure, i was feeling in some small measure. >> she is the chief financial officer for amvet here in washington. the president responded by saying he understands the frustrations of the american

people, but the recession was so severe, it's going to take time to get the economy back to where it was. at least one parent was arrested today after a melee that broke out at central high school in capital heights. the school went into a lockdown after a large police response and our reporter was there to talk to students who witnessed what happened. >> i'm scott broome in capital heights where a big fight broke out and involved the mother of one student. a mother who had come to the school to settle a score after her daughter allegedly had been attacked. >> it was this crazy. >> it escalated from earlier. > students described a melee just before noon today. >> it was -- >> one adult or several? >> it was several adults. >> where did they come from? who were they? >> i'm not sure. it came out of the blue. two girls were fighting and apparently came up to the school. >> a girl walked into the door and hit somebody with a shoe.

>> a large number of officers from both the prince georges county sheriff's department and police department responded to the incident and took control according to a police spokesman. there were at least ten arrests. >> there were a lot of people fighting. >> there were no serious injuries and no weapons involved, according to school officials. the school spent the rest of the day on lockdown and the day ended peacefully. in capital heights, scott broome, 9news now. >> the sheriff's department has not yet released the name of the adult that was arrested or said what charges have been field. a package caused gridlock. it was leaking a substance when it was delivered to a pharmaceutical company. crews came to clean up the substance. not clear what it was. sky 9 got a bird's eye view of a tractor trailer accident that caused a big mess in virginia. the rig jackknifed on the

beltway near galos road in fairfax county. that truck was carrying a large load of batteries when it crashed into the median. crews, hazmat again were called in to clean up a large fuel spill. a commuter alert for drivers who use i-270 in maryland. this thursday, the southbound lanes after exit 10, route 117 will be completely shut down for two 15 minute intervals. these closures will allow crews to post a sign. drivers can use route 355 as an alternative. >> let's check some other areas. patranya has her eyes on the roads. >> we are checking out some issues west side of the beltway. first, outer loop at route 50, we have an accident here causing some problems, delays up to 270 northbound and now 66, another crash past the beltway. that's causing some delays starting at route 7. talking about 66, let's take a live

years probation in florida. caps players admitted they received treatment, but deny he supplied them with steroids. police say they are skeptical about his claims the steroids were for his personal use. the man accused of killing the daughter of a north carolina police chief had a brief court appearance today in new york. michael harvey said he would not fight extradition. that means he will soon be headed back to north carolina. harvey is accused of killing valerie last week and dumping her body in a storage unit. hamilton was 23. that suspect was captured in niagra falls, new york. >> the lawmakers heard outrage in california have been arrested. the district attorney says several former and current city council members in the town of bell were taken into custody today. they include the manager robert rizzo who paid himself, get this, nearly $800,000 a year. >> the tax dollars collected

caught on tape, a 15-year- old boy who boarded a commercial flight in columbia

without a passport or ticket. he walked through several security check points before getting on the plane. the flight took him to chile. airport officials are investigating these clear security lapses. a dramatic rescue in india where an elderly man was pulled from gushing flood waters. look at that. a number of villagers had to help with the rescue. they used ropes. there were heavy rains that caused flooding in the area and the situation got worse when a dam broke. a rescue of a total different kind in china where a man was trapped nose deep in sand. emergency workers provided him with an oxygen tube and water while they try to stabilize the earth all around him. using spades and wooden planks, soldiers were able to free the man after several hours of being trapped. >> and this is some dramatic video. these stands holding 350 spectators collapsed in brazil. those fans were watching a motor race when the stands
